بررسی روش‌های قانونی رفع مسئولیت معلمان تربیت‌بدنی مدارس ایران در هنگام بروز حوادث ورزشی

چکیده

هدف اصلی این پژوهش، بررسی شیوه­های دفاع قانونی و مسئولیت دبیران تربیت­بدنی در حوادث ورزشی مدارس بود که با روش تحقیق توصیفی- همبستگی انجام شد. جامعه آماری تحقیق را کلیه معلمان تربیت‌بدنی مدارس ایران تشکیل دادند. با توجه به وسعت، تعداد و نیز، دشواری دسترسی به نمونه­ها؛ از روش نمونه‌گیری در دسترس برای جمع‌آوری نمونه‌ها استفاده شد که در نهایت 225 نفر در پژوهش شرکت کردند.. به منظور جمع­آوری داده­ها از پرسشنامه محقق­ساخته استفاده گردید. جهت تعیین روایی محتوایی پرسشنامه، از چند تن از استادان صاحب­نظر با گرایش ورزشی و حقوق نظرخواهی شد که پس از اعمال نظرات آنها، پرسشنامه تأیید گردید. به­منظور ارزیابی روایی و پایایی گویه­های پرسشنامه، در یک مطالعۀ آزمایشی تعداد 20 عدد پرسشنامه بین کارشناسان مربوطه توزیع شد که پایایی درونی گویه‌های پرسشنامه­ها به روش آلفایکرونباخ 87/0 بدست آمد. تحلیل داده‌های پژوهش با استفاده از نرم­افزارهای SPSS و LISREL انجام گرفت. یافته‌ها نشان­داد که عوامل فنی، عوامل مدیریتی، عوامل آموزشی و عوامل حقوقی بر رفع مسئولیت معلمان تربیت­بدنی در هنگام بروز حوادث ورزشی تاثیرگذار هستند. بنابراین، پیشنهاد مـی­شـود، ضـمن توجـه بـه ارتقـای مدرک تحصیلی معلمان تربیت­بـدنی، بـا اهتمـام بـه برگزاری کلاس­های ضمن­خـدمت و اطـلاع­رسـانی از طریق بروشورها، نصب تابلوهـای آموزشـی و هماننـد آن، میزان آگاهی­های حقوقی و مسئولیت­های مـدنی آنان نیز افزایش یابد.

چکیده [English]

The main purpose of this study was to investigating the legal methods of relieving the liability of physical education teachers in Iranian schools during sports accidents. the present study was descriptive-correlation in terms of research method. A researcher-made questionnaire was used to collect data. In order to determine the content validity of the questionnaire, the questionnaire was reviewed by several expert professors with sports orientation and opinion law. To estimate the reliability of the questionnaire, in a pilot study, the questionnaires was distributed among 20 participants and the internal reliability of the questionnaire was examined by Cronbach's alpha method (α = 0.87). The statistical population of the study consisted of all physical education teachers in Iranian schools. Given the size, number, and difficulty of accessing samples, available sampling method was used to collect data and finally 225 questionnaires were returned. The data were analyzed using SPSS and LISREL software. The findings showed that technical factors, managerial factors, educational factors and legal factors are effective in relieving the responsibility of physical education teachers in the event of sports accidents. Therefore, it is suggested that in addition to paying attention to the promotion in the educational degree of the teachers, by holding in-service classes and informing via brochures, installing educational boards, etc. their information about legal issues and responsibilities be increased.
